Terms of Use for Cura

1. Introduction and scope

These Terms of Use set out the conditions for using Cura websites, applications and support channels. They apply to international patients, companions and other visitors who use Cura to learn about medical tourism, health tourism or care coordination abroad.

By accessing or using Cura you agree to these Terms of Use. If you do not agree, you should not use the platform or related services.

These terms should be read together with our Privacy Policy, Cookie Policy, Payment and Deposit Terms and Cancellation Policy.

2. Who Cura is and what we do

Cura is an information and coordination service for medical travel. We help international patients connect with independent clinics, hospitals and other partners in Turkey, Iran and other destinations that we may support in the future.

Cura is not a clinic, hospital or medical provider. We do not provide medical treatment, make clinical decisions or control how clinics or clinicians practise medicine or dentistry.

Our role is to provide general information, collect your inquiry, support communication with clinics and partners, help coordinate logistics where agreed and assist with follow up communication within our service model. Medical decisions are made only by qualified clinicians who assess and treat you in person or through their own telemedicine arrangements.

3. Relationship between you, Cura and independent providers

When you use Cura to contact a clinic, doctor or other partner, you usually enter into a direct relationship with that provider. Any diagnosis, treatment, medical advice, clinical follow up, hotel stay, transport service or other third party service is provided under that provider’s own terms and local law.

Cura is not a party to the medical treatment contract between you and the clinic or doctor. We are also not a party to contracts for accommodation, transport or other non medical services unless we clearly state this in writing for a specific service.

Clinics and partners remain fully responsible for their own staff, facilities, equipment, professional licences, registration, insurance and compliance with health, safety and consumer rules.

Cura may receive a service fee or commission from clinics or partners for coordination work or completed bookings. This does not change the independence of providers or your rights under local law.

4. Where these terms apply

Cura currently supports care mainly in Turkey and Iran and may add other destinations later. Legal rules for healthcare, data protection and consumer rights differ between countries.

In Turkey, the main data protection framework is the Law on the Protection of Personal Data and related regulations. In Iran, there is not yet one comprehensive data protection law, but several laws, draft acts and sector rules address the protection of personal information, including health data.

Turkey and Iran also have patient rights charters and healthcare regulations that address access to information, informed consent, privacy and fair handling of complaints in medical settings.

Turkey applies consumer and distance contract rules to many online and distance services, including some health related services, subject to specific exceptions and conditions.

These terms are intended to sit alongside mandatory legal rules. They do not limit any non waivable rights you may have under the law of your home country or the country where services are provided.

5. Eligibility and use of the services

You may use Cura only if you:

  • Are at least 18 years old and have legal capacity to enter into agreements in your country or
  • Are a parent or legal guardian acting on behalf of a minor or a person who cannot act for themselves or
  • Are a close family member or legal representative who is allowed by local law to help arrange care for another person

By using Cura, you confirm that the information you submit is accurate to the best of your knowledge and that you have authority to share details for any person you represent.

6. User responsibilities

When using Cura you agree to:

  • Provide accurate, complete and current information about your identity, contact details and travel plans
  • Provide honest information about your health history, previous treatments, medications and risk factors when you choose to share health information
  • Tell your Cura coordinator and the clinic promptly if your health status, medications, pregnancy status or other important factors change before treatment
  • Carefully read and follow instructions and advice from your treating clinicians and local health authorities
  • Use Cura only for lawful purposes and in a respectful way
  • Keep your login details or access codes secure and avoid sharing them without need
  • Check and confirm all booking conditions with clinics and partners before you travel

You are responsible for decisions about travel, insurance, visas, time off work and other personal duties. Cura may provide general information as a convenience, but you must confirm details with official sources.

7. Health information and no medical advice

Content on Cura, including articles, procedure descriptions, answers to common questions and coordinator messages, is for general information only. It is not medical advice and cannot replace consultation with qualified clinicians.

Any decision to have or not have a procedure must be made after a full clinical assessment by a licensed doctor, dentist or other qualified professional who can evaluate your situation in detail. You should discuss benefits, risks, alternatives, expected recovery and possible complications directly with your treating team.

If you have a medical emergency, contact local emergency services and nearby healthcare providers, not Cura.

8. How inquiries, bookings and communications work

You can contact Cura through an online form, messaging tools, email or phone. When you submit an inquiry, we may ask for photos, test results or other medical history to support triage and matching.

We normally share your inquiry and selected information with one or more clinics or providers that may be suitable based on location, procedure type, language and other factors you have shared. The clinic or provider may then send questions, a treatment suggestion or an estimated plan.

Any quote, treatment plan or package shared through Cura is based on limited information and is usually indicative. Final clinical decisions, exact prices and final treatment plans may change after an in person examination, tests or additional information.

We may record and store communications that pass through our systems to support coordination, quality checks and dispute handling, in line with our privacy practices.

9. Role of clinics and partner providers

Clinics, hospitals, surgeons, dentists, hair specialists, laboratories, hotels, transport companies, interpreters and other partners that you may meet through Cura are independent entities. Cura does not own or control them.

Independent providers are responsible for:

  • Deciding whether a proposed treatment is safe and appropriate for you
  • Obtaining informed consent and explaining benefits, risks and alternatives
  • Ensuring their staff hold the required qualifications and licences
  • Maintaining facilities, equipment and infection control
  • Keeping medical records and respecting privacy in line with local rules
  • Handling clinical complaints and complications under local law and professional standards

Cura is not responsible for clinical decisions, surgical techniques, prescription choices, follow up schedules or any other aspect of medical or dental practice provided by independent clinicians.

10. Fees, payments and financial arrangements

Our general approach to deposits, coordination fees and payments is explained in our Payment and Deposit Terms.

In many cases, you pay most or all medical treatment costs directly to the clinic, hospital or doctor according to their terms. For some services, Cura may facilitate deposits or other payments on behalf of clinics or partners, where this is clearly described before you pay.

Banks, card providers and payment processors have their own terms and may charge fees or apply exchange rates that Cura does not control.

11. Cancellations, changes and refunds

Rules about cancellations, changes and refunds for medical and non medical services are explained in more detail in our Cancellation Policy. Clinics, hotels and other partners have their own policies, which may be strict, especially for short notice changes.

Cura can help you communicate with providers about cancellations or changes, but cannot promise any particular financial outcome.

12. Acceptable use of the platform

You agree not to use Cura for any activity that is unlawful, offensive or harmful. In particular, you must not:

  • Share information that is fraudulent, misleading or impersonates another person without clear authority
  • Post or send content that is abusive, threatening, hateful or discriminatory
  • Upload content that violates privacy, intellectual property or confidentiality rights
  • Attempt to interfere with or damage the platform, servers or security measures
  • Use automated tools to scrape large amounts of data without our written permission
  • Promote products or services unrelated to medical travel coordination without consent

We may suspend or restrict access if we reasonably believe that your use of the platform breaches these rules or creates risk for other users, clinics or partners.

13. Intellectual property

The Cura platform and its content are protected by intellectual property laws. This includes website design, software, databases, text, procedure descriptions, graphics, logos and trademarks unless stated otherwise.

You may use the site and view content for your personal, non commercial use when planning or researching medical travel. You may not copy, modify, translate, distribute, sell, license or create derivative works from our content or systems without prior written permission, except where clearly allowed by law.

Names, logos and marks of clinics, hospitals or other partners on the platform may be protected by their own rights. Their use on Cura does not give you any licence to use them outside the platform.

14. Third party content and links

Cura may include links to websites, applications or services that we do not own or control. We may also show content or tools from third parties such as maps, videos or chat tools.

We provide these links and tools for convenience. We do not endorse or control their content, policies or practices. You should review the terms and privacy information of any third party sites or services that you choose to use.

15. Data protection and privacy

Our Privacy Policy explains how we collect, use and share personal data, including any health related information you choose to send to us.

We aim to apply appropriate safeguards that reflect data protection expectations in Turkey, Iran and other relevant countries, taking into account Turkish data protection law and the evolving framework for privacy and health information in Iran.

Because Cura supports cross border care, some data may be processed or stored in other countries. We describe these practices and your rights in the Privacy Policy.

16. Warranties and limitations of liability

Cura provides its platform and coordination services using reasonable care and skill. However, we cannot and do not promise that:

  • The site will always be available without interruption or error
  • Information on the site will always be complete, current or free of mistakes
  • Any particular treatment, result or outcome will be suitable for you

To the extent allowed by applicable law, Cura is not liable for:

  • Clinical decisions, acts or omissions of doctors, dentists, clinics or any healthcare professionals
  • Acts or omissions of hotels, transport providers or other non medical partners
  • Losses that arise from information you did not share or that you shared inaccurately
  • Indirect or consequential losses such as lost earnings or time off work

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by proven gross negligence or intentional misconduct where such limits are not permitted.

17. Governing law and jurisdiction

These Terms of Use are mainly governed by the law of the country where the Cura operating company is established. Details of the operating company and its country will be shown on our site or legal information page.

If you are a consumer, mandatory consumer protection rules in your own country may also apply and may give you additional rights. These terms do not limit any such non waivable rights.

Any dispute relating to these terms that cannot be resolved through informal discussion may be brought before the courts in the country where the Cura operating company is established or before courts that mandatory local law allows for consumers.

18. Changes to these terms

We may update these Terms of Use from time to time. Reasons may include changes in our services, new destinations, updates to law or regulation in Turkey, Iran or other countries, or improvements to clarity.

When we make significant changes, we will update the date at the top of the terms and may display a notice on the site or in the app. If you continue to use Cura after changes take effect, you are considered to have accepted the updated terms.
